1. About these terms
These terms are an agreement between you and BuildFitLabs, a company registered in Egypt ("we", "us"), covering your use of the Gainix mobile app and these pages. By creating an account or using the app you accept them. If you do not accept them, please do not use Gainix.
Our Privacy Policy explains how we handle your personal information and forms part of these terms.
2. Who can use Gainix
You must be 16 or older to create an account. By creating one you confirm that you are. If we learn that an account belongs to someone under 16, we will delete it.
You should also be well enough to exercise and to change what you eat. If you are unsure, speak to a doctor first — see section 4.
3. Your account
- Give accurate information when you sign up, and keep it up to date. Your calorie and macronutrient targets are calculated from what you enter, so wrong inputs produce wrong targets.
- Your account is for you alone. Do not share your login with anyone.
- Keep your password secure and tell us promptly if you think someone else has access to your account.
- You are responsible for what happens on your account.
4. What Gainix is — and what it is not
Gainix is a fitness and nutrition tool, not a medical service. It does not provide medical advice, diagnosis or treatment, and nothing in the app is a substitute for a qualified healthcare professional.
The calorie, protein, carbohydrate and fat targets Gainix shows you are estimates produced by standard formulas from the information you enter. They are a general guide for healthy adults. They are not personalised medical guidance and they cannot account for everything about your body or your health.
You should talk to a doctor before you start a new exercise programme or significantly change your diet, and you should do so in particular if you:
- have a medical condition, including diabetes, heart disease, high blood pressure or an eating disorder;
- are pregnant, may be pregnant, or are breastfeeding;
- are recovering from injury or surgery;
- are taking medication that affects your diet, your blood sugar or your ability to exercise.
The health information you record — conditions, injuries, allergies and dietary rules — helps the app avoid suggesting food or movements that are unsuitable for you. It works only from what you tell it. If you do not record an allergy, the app cannot avoid that food. Always check the ingredients of anything you eat yourself.
Stop exercising and seek medical help if you feel pain, dizziness, chest discomfort or shortness of breath. You take part in physical exercise at your own risk.
5. Your content
What you record in Gainix — your logs, your measurements, your notes — remains yours. You give us permission to store and process it only so that we can operate the app for you, as described in the Privacy Policy.
The app itself, including its design, its text, its food and exercise data and its software, belongs to us. You may use it personally through the app; you may not copy, resell, or extract our content or data from it.
6. Acceptable use
Please do not:
- use Gainix for anything unlawful, or to harm or harass anyone;
- try to access another person's account or data;
- attempt to break, overload, probe or reverse-engineer the app or our systems;
- extract our food, exercise or nutrition data in bulk, by automated means or otherwise;
- impersonate anyone, or submit information you know to be false.
We may suspend or close an account that breaks these rules.
7. Changes to the app
We are actively developing Gainix. Features may be added, changed or removed, and updating the app may change these terms and our Privacy Policy along with it.
The current versions are always published at gainix.app/terms and gainix.app/privacy, and the date at the top of each page tells you when it last changed. We do not send individual notices of changes — please check those pages from time to time. Continuing to use Gainix after a change means you accept it.
8. Paid features
Gainix is currently free to use and the app does not take payments. If we introduce paid features, we will publish the price, what it includes and the refund position before you are asked to pay for anything, and you will never be charged without agreeing first.
9. Ending your use
You can stop using Gainix at any time and delete your account from Profile → Delete Account, or by emailing us. Deletion in the app is immediate and permanent — see our account deletion page.
We may suspend or close your account if you breach these terms, if we are required to by law, or if we discontinue the service. If we discontinue Gainix entirely we will give you reasonable notice and a chance to retrieve your data.
10. Your responsibility, and the limits of ours
You use Gainix at your own risk. Gainix gives you information, estimates and suggestions. Every decision about what you eat, how you train and how hard you push is yours alone, and you take it as an adult responsible for your own health.
What you are responsible for
- Deciding whether any plan, target, meal or exercise is appropriate for your body, your health and your circumstances.
- Obtaining medical advice before you begin and while you continue. We tell you to consult a doctor in section 4 and inside the app; whether you do so is your decision, and the consequences of not doing so are yours.
- Checking the ingredients of anything you eat, whatever the app suggests.
- Stopping, and seeking medical help, if you feel pain, dizziness, breathlessness or anything else wrong.
- The accuracy of what you enter. Every target is calculated from your own inputs — inaccurate inputs produce inaccurate targets.
- Any decision to depart from what the app suggests, including eating less, training harder or training more often than it sets out.
By using Gainix you confirm that you are in good enough health to exercise and to change your diet, or that you have taken medical advice and are acting on it. If neither is true, do not use Gainix.
What we do not promise
We provide Gainix "as is" and "as available". We do not promise that it will be uninterrupted or error-free, that its estimates, plans or suggestions will suit you or any particular person, or that using it will produce any particular result — including any change in your weight, strength, fitness or health.
What we are not liable for
To the fullest extent the law allows, we are not liable for:
- any injury, illness, health outcome, or worsening of any condition arising from your use of Gainix, or from following, adapting or disregarding anything it suggests;
- any decision you make about diet, exercise, supplements or medication;
- any consequence of relying on the app instead of a qualified medical or nutrition professional;
- indirect or consequential loss of any kind, including lost time, lost earnings and wasted expenditure;
- loss or corruption of your data.
Where we are liable despite the above, our total liability to you for all claims taken together is limited to the amount you have paid us in the twelve months before the claim arose. While Gainix is free to use, that amount is nil.
Nothing in these terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, or for fraud.
11. Governing law
These terms are governed by the laws of the Arab Republic of Egypt, and the courts of Egypt have jurisdiction over any dispute arising from them. If any part of these terms is found unenforceable, the rest continues to apply.
